Our website is hosted by our data processing company Platform SH, Platform.sh GmbH, Marienstr. 90, 50825 Cologne, Germany.
Connection data is processed for the purpose of providing and delivering the website. For the mere purpose of delivering and providing the website, data is not stored beyond the request. However, connection data is stored by our data processing company for security purposes. The duration of processing for security purposes is variable and ends when the security measures are no longer necessary. Furthermore, our data processing company anonymises the data collected immediately after its collection and makes the anonymous data available to us in the form of statistics for evaluation. We use these statistics for fault resolution and to further develop our website.
The legal basis for the data processing is the absolute technical necessity for providing and delivering the service expressly requested by your request www.austroflamm.com pursuant to § 96 para. 3 of the TKG.
Server log files
Connection data is handled for the purpose of monitoring technical function and to increase the operational security of our web host. In terms of log file rotation, log files are stored until they reach a 100 Mb limit and on reaching the 100 Mb limit are automatically overwritten or deleted. Storage duration is approximately 60 days. The legal basis for the data processing is the absolute technical necessity of a server log file as a basic database for defect analysis and for security measures within the scope of the service expressly requested by your request www.austroflamm.com pursuant to § 96 para. 3 of the TKG.
Forms
Contact form
On our website, there is the option to contact us directly via a contact form. Once the contact form is sent, the personal data entered by you is processed by Austroflamm GmbH for the purpose of dealing with your query on the basis of the consent you gave by sending the form pursuant to Art. 6 para. 1 item. a GDPR. Data is processed until revoked. There is no statutory or contractual obligation to provide the personal data. The only consequence of failure to provide it is that your request will not be submitted and we cannot deal with it.
Registration / web shop
The data entered within the scope of registration is used for the purpose of using our web shop and for later contract settlement. Beyond that, for the purpose of contract settlement the following data is also stored: Salutation, first name, surname, street, residence number, post code, location, telephone number, e-mail address. The data provided by you is necessary for the performance of contract or execution of precontractual measures. Without this data, we cannot enter into a contract with you. Data is not transmitted to other recipients.
Data storage / web shop
We would like to point out that for the purpose of a simpler purchasing process and for later contract settlement, the IP data of the party is stored by the web shop operator in the context of cookies, as are the name, address, telephone number and E-mail address of the buyer.
Beyond that, for the purpose of contract settlement the following data is also stored with us: name, address, telephone number and E-mail address. The data provided by you is necessary for the performance of contract or execution of precontractual measures. Without this data, we cannot enter into a contract with you. There is no data transfer to third parties, with the exception of submitting credit card data to the processing bank/payment service provider for the purpose of debiting the purchase price, to the transport or shipping company commissioned by us for delivering the goods, and to our tax accountants to meet our legal tax obligations.
Once the purchase process is cancelled, the data stored with us is deleted. In the event of a contract being concluded, all data from the contractual relationship is stored until the legal retention requirement for tax purposes expires.
The name, address, purchased goods and sales date data is stored beyond this until the product warranty (10 years) expires. Data is handled on the basis of the statutory of § 96 para. 3 TKG and Art 6 para. 1 item a (consent) and/or item b (necessary for performance of contract) of GDPR.
Google Analytics
If you have given your consent, Google Analytics 4, a web analysis service of Google LLC, is used on this website. The responsible body for users in the EU/ EWR and Switzerland is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”).
Scope of processing
Google Analytics uses cookies, which enable an analysis of how you use our web pages. The information on your use of this website collected by means of cookies is generally transmitted to a Google server in the USA and stored there.
We use the User ID function. By using User ID, we can assign to one or more sessions (and the activities within these sessions) a unique and permanent ID and analyse user behaviour across devices.
In Google Analytics 4, anonymization of IP addresses is activated by default. Due to IP anonymization, your IP address within the member states of the European Union or in other signatory states of the Agreement on the European Economic Area is abbreviated by Google. Only in exceptional cases, is the full IP address sent to a Google server in the USA and abbreviated there. According to Google, the IP address transmitted by your browser within the scope of Google Analytics is not merged with other Google data.
During your visit to the website, your user behaviour is recorded in the form of “events”. Events can be:

· Your “click path”, interaction with the website
· Scrolling (always when a user scrolls down to the bottom of the page (90%))

Purpose of processing
Google will use this information on behalf of the operator of this website in order to evaluate your use of the website and to compile reports on website activity. The reports provided by Google Analytics are used to analyse the performance of our website and the success of our marketing campaigns.

Third-country transfer
Insofar as data is processed outside the EU/EEA and there is no level of data security meeting the European standard, we have agreed upon the creation of an appropriate level of data EU standard contract clauses with the service provider security. The parent corporation of Google Ireland, Google LLC, has its headquarters in California, USA. A transfer of data to the USA and access by the US authorities to the data stored with Google cannot be ruled out. From the point of view of data security law, the USA counts as a third country. You do not have the same rights there as within the EU/EEA. You may have no legal redress against access by authorities.
Duration of storage
The data sent by us and linked to cookies is automatically deleted after 14 months. Data whose retention period has been reached is automatically deleted once a month.
Legal basis
Legal basis for this data processing is your consent pursuant to Art. 6 Para 1 S.1 Item a GDPR.
Revocation
You may revoke your consent at any time with effect for the future by clicking Opening cookie settings and changing your selection there. The legitimacy of the processing that has been carried out on the basis of your consent up to the point of revocation shall remain unaffected by this.
Google Tag Manager
To administer our website and integrate cookie-based technologies we use the Tag Manager service, which is offered by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). For this purpose, every time you visit one of our Internet pages, your IP address is transmitted to a Google server, which may also be located in the USA. The IP address is not stored by Google within the scope of the Tag Manager Service and only used for the integration of the technologies managed by Tag Manager. Tag Manager itself does not set any cookies.
Google web fonts
For displaying the font our website uses so-called web fonts. These are provided by Google (http://www.google.com/webfonts/). For this purpose, when you visit our page, your browser loads the required web font into your browser cache. This is required so that your browser too can display a visually improved version of our text. If your browser does not support this function, a standard font is used by your computer for display purposes.

Right to object
Provided that the processing of your personal data is based on legitimate interest, you have the right to object to this processing. If there are no compelling legitimate reasons for processing on our part, the processing of your data based on this statutory basis will be discontinued. Furthermore, you have the right to object to the processing of your personal data for the purpose of direct advertising. In the event of objection, your personal data will no longer be handled for the purpose of direct advertising. The legitimacy of the data handled up to the point of objection is unaffected by the objection.
Right of cancellation
You have the right at any time to revoke consent that has already been given. In the event of consent to the receipt of electronic advertising, this consent can be cancelled by clicking on the Unsubscribe link. In this case processing will be discontinued, provided no other statutory basis exists. The legitimacy of the data handled up to the point of cancellation is unaffected by the cancellation.

Furthermore, you have the right to information, rectification, erasure and restriction of processing of personal data. Insofar as the legal basis for the processing of your personal data is your consent or a contract concluded with you, you also have the right to data portability. Licence agreement for WiRCU end users
This end user agreement is a legal contract concluded between Austroflamm GmbH, Austroflamm Platz 1, 4631 Krenglbach, Austria (hereinafter “Austroflamm”) and the end user (hereinafter “you”) of the WiRCU device from Austroflamm and the WiRCU app (“PelletControl”) (jointly “WLAN BOX”).
With the conclusion of this end user agreement Austroflamm grants you a non-exclusive right, which can be withdrawn at any time, to the use of this app in accordance with its purpose for your personal use.
Within the scope of this agreement, you receive only one licence, and no provision of this agreement should be understood as making you owner of the app or its parts. At any point in time, the app remains in the ownership of Austroflamm, who can at any time at their discretion withdraw, deactivate or cease support for it.
Unless expressly agreed otherwise in writing with Austroflamm, neither this agreement nor any other action on your part or the part of Austroflamm shall entitle you to use the app entirely or partially for commercial purposes or to use parts thereof for purposes other than monitoring and controlling your own heating appliance in compliance with the instructions for use.
Under no circumstances may the app be modified, copied, reverse engineered, sublicensed, sold, publicly displayed, disassembled, lent, hired out or borrowed by you, and you may not circumvent any technical security measures of the app except to the extent that this is expressly permitted by a valid law irrespective of this restriction.
You agree to the app collecting your personal data and data on the operation of your heating appliance when this data is required for the operation of the app or of the services connected to the app, as well as other data in compliance with the WiRCU data protection declaration. By entering data into the app or allowing data to be entered into or collected by the app, you consent to the storage, transfer and use of this information for purposes in compliance with the functions of the app and the WiRCU data protection declaration.
Austroflamm may update the app from time to time and make Service Packs available for the app, but is not obliged to do so.
Any liability of Austroflamm that arises from or in connection with the app, its use or functions, effects or defects, is herewith explicitly excluded by you and in no event will exceed the amount that you have paid Austroflamm for the acquisition of this licence under this agreement.
The app is made available “as is” without warranty. You assume the entire risk in connection with the use or performance of the app.
By accepting this end user agreement and/or the use of the app, you agree to and confirm the following:
· that you have ensured a proper incorporation of the device into your heating appliance taking into account and the necessary steps and requirements for the safe operation of the heating appliance;
· that the heating appliance being used meets the requirements of the device and is not damaged in any way, that it works according to its settings and is suitable for proper and safe control by the product;
· that the heating appliance and its operation must be constantly monitored;
· That the app and the appliance in your possession are only ever accessible to adults who can assess and control their actions and who are familiar with the necessary actions for the safe operation of the product and the heating appliance;
· that for the duration of the installation of the app, the device on which the app is located must not be made publicly accessible, loaned, rented, sold or passed on to third parties outside your sphere of influence, and that it must be protected by a secure password against unauthorised use that must not be disclosed to persons other than those referred to in the previous paragraph, for whose actions you assume full responsibility;
· that you are familiar with the functions of the app and of the appliance and know the procedure and results of all functions and processes or a combination thereof that can be controlled or affected by the app and the appliance, and that you will instruct all other persons who may have access to the app and to the appliance or its parts in their safe use;
· will take all appropriate measures to prevent unauthorised persons from access to or use of the app and the appliance;
· will securely use and store all user names, passwords, certificates and other security elements that are intended to ensure the reliable and safe operation of the app and the appliance;
· waive all claims against [company] or persons connected to [company] based on damage by or in connection with the app and the appliance and indemnify [company] from all such claims by third parties based on the use, functions or operation of the application and of the appliance to which access has been granted under this agreement.
This agreement is concluded for an indeterminate period and may be amended, annulled or revoked at any time by Austroflamm.
WiRCU data protection declaration
This data protection declaration applies to the WiRCU app (“PelletControl”) from Austroflamm, which together with the WiRCU device from Austroflamm constitutes the WiRCU product (“WLAN-BOX”).
The product is distributed directly or by means of subdistribution by Austroflamm. Austroflamm is obliged to protect personal data in compliance with the legal system of the European Union and Austrian laws.
Certain information may be collected and stored when using the product. This information may be personal data from the user (you) or technical information on the operation of the product and the appliances to which it is tethered or otherwise connected and with which it is associated.
By the acquisition, installation and further use of the product you agree to this data protection declaration and the conditions that apply to the use of the product and which may be amended from time to time. You agree to the app collecting your personal data and data on the operation of the heating appliance, provided this data is required for the operation of the product or of the services connected to the app. By entering data into the app or allowing data to be entered into or collected by the app, you agree to the storage, transfer and use of the information for purposes in compliance with the functions of the product or other purposes described here.
We can collect and store two types of information but are not obliged to do so.
· Information that has been deposited by you by the voluntary transmission of this data to us or into the product, by having entered this data into the product or agreed to access by this product to this data; this information may be of a technical, personal or other nature;
· Information that is collected by the product during its operation, which may be of either a technical or an operational nature and relates to the operation of the product and to the appliances tethered or connected to the product.
Please note that both types of information referred to include all information made available or accessible to the product that is directly related to its operation or function, irrespective of input channel or -form, and that it cannot be assumed that data which is relevant to the product or your heating appliance connected to the product has not been collected and stored. However, the app does not access information, which is contained in your appliance, with the exception of the WiRCU device from Austroflamm, which is not directly related to the functions of the product, and also does not process this without your agreement.
The product may use tracking technologies, which monitor the activities of the product and connected appliances and log them in your appliance or externally. Such data may make your preferences and activities identifiable in respect of the operation of the product or appliances associated with it.
We use your personal data only for the original purposes for which it was made available to us, including contacting you in respect of the operation of the product or of an appliance connected to it.
Your personal data shall neither be sold nor otherwise disclosed to unaffiliated third parties, except to those who provide services for the operation of the product, without your consent at the point of collection or subsequent agreement. In this case, only absolutely necessary information is made available. Some of the personal data collected (MAC address of the appliance, a unique identification number assigned to the WiRCU device) and non-personal data (data on the operation of the heating appliance) we do however disclose to the product developer (Atech elektronika d.o.o., Bač pri Materiji 30, Materija, Slovenia (hereinafter "Atech”); contact: +386 8 200 88 00, info@atech.si). Forwarding the data mentioned above to Atech allows Atech to analyse the customer software for its own purposes and further develop the design and structure of the product to improve content and adapt it to the interests of our users. Your personal data collected for statistical and research purposes are automatically added into Atech’s database and subsequently anonymised so that it can longer be connected to an individual person. You may demand at any time that Atech erases all information collected up to that particular point.
We may also use the information collected to submit suggestions to you from third parties on the operation of the product or appliances associated with it and offers for services relating to this, or products and advertising of updates or customer services or to otherwise support the operation of the product or appliances associated with it. Information may also be used for targeted advertising, and we may forward information collected to affiliated companies.
We may allow trusted third parties to store or process your information if this is required for operation of the product. Generally, the information is stored in a cloud.
We may in particular cases disclose information collected if we have reason to assume that the disclosure of this information is necessary to identify, contact or take legal steps against someone who is infringing our conditions of use or our rights, our property, our customers or other persons who may sustain loss via such actions.
If your personal data might be disclosed to third parties for reasons other than the one cited in this data protection declaration, you will be informed by us of this beforehand, and you may request us not to disclose this information.
We are committed to the protection of the information that we receive from you. We take appropriate security measures to protect your information in accordance with the EU statutory provisions against unauthorised access or unauthorised modification, disclosure or destruction of data. To prevent unauthorised access and to ensure data accuracy and the correct use of information, we employ appropriate physical, electronic and administrative procedures. We are of the view that the measures taken by us reduce the probability of security problems to a level suitable for the relevant type of data.
You may require us at any time to erase all information collected up to that particular point in connection with the product in your possession. We will do this as well, or you will receive from us the necessary instructions so that you can carry this out yourself.
We do not solicit any personal data from children. If you are not yet of legal age, you must not use the product without supervision by a parent or guardian.
We reserve the right to amend this data privacy statement at our discretion from time to time. Should there be in future an amendment to our data privacy statement, the amendment shall only relate to information that has been collected after the modified data privacy statement came into force, unless we receive your explicit consent. By continuing to use the product, you declare yourself in agreement with these amendments.
WiRCU End-Users Licence Agreement
This end user agreement is a legal agreement, entered in by and between Austroflamm GmbH, Austroflamm Platz 1, 4631 Krenglbach, Austria (hereinafter "Austroflamm") and the end user (hereinafter "you") of Austroflamm’s WiRCU device and/or WiRCU application ("PelletControl") (together " WLAN-BOX ").
By entering into this end user agreement, Austroflamm grants you a non-exclusive and at any time revocable right to use the Application in accordance with its purpose, for your personal use.
You are under this agreement granted a licence only, and no provision of this agreement may be understood to represent the grounds for you becoming the owner of the Application or its parts. The Application shall at all times remain property of Austroflamm, which may recall the Application, disable it or terminate any support for the Application at any time of its choosing.
This agreement or any other act of, either you or Austroflamm, does not entitle you to use the Application in part or as whole for commercial reasons or to use any of its parts for other reasons than to monitor and control your own heating device in accordance with instructions for use, unless expressly agreed upon otherwise with Austroflamm in writing.
You are in no circumstance entitled to modify, copy, reverse engineer, sublicense, distribute, publicly demonstrate, disassemble, rent, lease or lend, or to circumvent technical protection measures of the Application, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
You agree that the Application may collect your personal data and data on operation of the heating device, if such data are required for operation of the Application or with the Application associated services and other data in accordance with the WiRCU Privacy Policy. By entering data into Application or allowing the data to be entered into or collected by the Application, you agree that all such information can be stored, transmitted and used for purpose in accordance with the Application's functionalities and WiRCU Privacy Policy.
Austroflamm may from time to time update the Application or provide service packs for the Application, but is under no obligation to do so.
Any liability of Austroflamm, in regard to or arising from or in connection to the Application, its use or functionalities, effects and defects is hereby explicitly waived by you and shall in no case exceed the amount, paid by you to Austroflamm for obtaining the licence under this agreement.
Application is supplied “as is” without warranty of any kind. The entire risk arising out of use or performance of the Application remains with you.
By accepting this end user agreement or by using the Application, you agree and confirm:
- that you have assured a proper instalment of the Device onto the corresponding heating device, observing all the necessary steps and requirements for the safe operation of the heating device;
- that the heating device used corresponds to the requirements of the Device and is in no way damaged, operates in accordance with its settings and is suitable for being properly and safely controlled by the Product;
- that the heating device and its operation shall be monitored at all times;
- that the Application and/or Device in your possession shall at all times be available only to adults, capable of proper judgement and control of their actions, familiar with measures necessary for safe operation of the Product and heating device;
- that the device containing the Application shall not be made publicly available, lent, rented, sold or handed to any third person outside your control for as long as the Application is installed and that it shall be protected from unauthorized use by a secure password, which shall not be shared with any person other than those from the above paragraph, for actions of which you shall accept full responsibility;
- that you are fully familiar with the functionalities of the Application and/or Device and are aware of the mode of operation and consequences of all individual functions and procedures or combinations thereof, as may be controlled or influenced by use of the Application and Device, and shall instruct on safe use of the Application and/or Device all other persons, that might have access to the Application and/or Device or parts thereof;
- to take all reasonable measures to prevent any by you unauthorised person to access or use the Application and/or Device;
- to use and keep secure all usernames, passwords, certificates and other security elements, intended to assure safe and secure operation of the Application and/or Device;
- to waive all claims against [Company] or any with [Company] associated person for any damage, caused by or in connection with the Application and/or Device, and to keep [Company] free of any such claims by any third person, based on use, functionalities or mode of operation of the Application and/or Device as granted access to under this agreement.
This agreement is entered for undefined period of time and may be amended, cancelled or revoked by Austroflamm at any time.
WiRCU Privacy Policy
This privacy policy applies to Austroflamm’s WiRCU application ("PelletControl"), which together with the Austroflamm WiRCU device forms the WiRCU product ("WLAN-BOX”).
The Product is distributed directly or through sub-distribution by Austroflamm, which is bound to protect personal information in accordance with the legal order of European Union and the Austrian legislation.
The Product may collect and/or store certain information. Such information may have the nature of personal information of the user (you) or technical information on operation of the Product and devices to which it is attached or otherwise connected or associated to.
By procuring, installing and/or continuing to use the Product, you agree to this Privacy Policy and terms and conditions, as are applicable to the use of the Product and may be amended from time to time. You agree that the Application may collect your personal data and data on operation of the heating device, if such data are required for operation of the Product or with the Product associated services. By entering data into Application or allowing the data to be entered into or collected by the Product, you agree that all such information can be stored, transmitted and used for purpose in accordance with the Product's functionalities and other purposes described herein.
We may, but are not obliged to, collect and/or store two types of information:
- information specifically proved by you through voluntary submission of such data to us or into the Product by entering such data into the product or agreeing for the Product to have access to such data, which may be of technical, personal or other nature;
- information that is collected by the Product during its operation, which is either of technical or operational nature and refers to operation of product and devices attached to or connected with the Product.
Please note that the mentioned two types of information include all and any information provided or made available to the Product that are directly connected with its operation or functionalities, regardless of the input channel or form and that assumption that any data, relevant to the Product or your heating device connected to the Product are not collected and/or stored should not be made. The Application does however not access, store, or process any information contained in your device, other than Austroflamm’s WiRCU device that does not have direct connection with the functionalities of the Product without your permission.
The Product may use tracking technologies that monitor activities of the Product and connected devices and log them into your device or externally. Such data may indicate your preferences and/or activities in regard to operation of the Product or with it connected devices.
We will use your personal information only for the original purposes it was given, which included contacting you in regard to operation of the Product or any device connected to the Product.
Your personal information will not be sold or otherwise transferred to unaffiliated third parties without your approval at the time of collection, or later consent, except to those, providing services for operation of the Product, in which case any information shall be made available only on need to know basis. We will however share some of the collected personal data (device’s MAC address – a unique identification number assigned to WiRCU device) and non-personal data (data on operation of the heating device) with the developer of the Product (Atech elektronika d.o.o., Bač pri Materiji 30, Materija, Slovenija (hereinafter "Atech”); Contact: +386 8 200 88 00, info@atech.si). By transferring above-mentioned data to Atech, Atech will be able to analyse customer software usage for its own purposes and develop the design and layout of the Product in order to improve the content to better match the interest of our users. Your personal data collected for the purpose of statistics and research is entered in Atech’s databases automatically and is anonymised after its entrance in such way it can no longer be associated with an individual. You may at any time ask Atech to delete all information collected in regard to the Product until such time.
We may also use collected information to present you with suggestions given by third parties in regard to operation of the Product or with it connected devices and/or with offers to provide services or products in regard and to promote upgrades or customer services or otherwise support operation of the Product or with it connected devices. Information may also be used for targeted advertising and we may share collected information with affiliated entities.
We may permit certain trusted third parties to store or process your information, as may be required for operation of the Product. Information is generally stored in a cloud.
We may disclose collected information in special cases where we have reason to believe that disclosing such information is necessary to identify, contact or bring legal action against someone who may be violating our terms and conditions of use or may be causing injury or interference with our rights, property, our customers or anyone who could be harmed by such activities.
